General Terms and Conditions (GTC) of design engineering Erdei GmbH

§ 1 Scope

1. For online goods orders from design engineering Erdei GmbH, the following general terms and conditions apply exclusively

2. The version of these GTC valid at the time of the order applies. Deviating regulations only apply if they have been confirmed in writing by design engineering Erdei GmbH.

§ 2 Formation of the contract

1. Your order represents an offer to us to conclude a purchase contract. If you place an order with design engineering Erdei GmbH, we will send you an e-mail confirming receipt of your order and listing its details (order confirmation). This order confirmation does not constitute acceptance of your offer, but is only intended to inform you that we have received your order. A purchase contract is only concluded when we send the ordered product to you and/or confirm the dispatch to you with a second e-mail (dispatch confirmation).

§ 3 Revocation and return

1. The customer can, for his part, revoke the contract in writing or by returning the goods within two weeks of receipt of the goods. It is pointed out that design engineering Erdei GmbH may withhold any depreciation caused by the use of the item.

2. If the goods are returned within the two-week period and the order value is more than EUR 100, design engineering Erdei GmbH will reimburse the costs of the return.

3. If the goods are returned with a value of more than 500 euros, the goods must be sent back as a specially secured valuables, eg as a value package. The resulting additional costs are borne by design engineering Erdei GmbH

4. For goods that are returned outside the statutory two-week period, design engineering Erdei GmbH assumes neither the return costs nor liability for loss or damage.

§ 4 Delivery and shipping costs

1. Unless otherwise agreed, delivery will be made to the delivery address specified by the customer. Information about the delivery period is non-binding, unless the delivery date has been promised as an exception.
    

2. The shipping costs are calculated depending on the value of the goods, weight and destination country and are always shown in the e-mail order and the order confirmation.
    

§ 5 Prices and Payment

1. All online prices are exclusive of VAT.
   When sending the offer or order confirmation, VAT will be added.
    

2. We also offer educational versions of some goods. 
   The goods then have the addition "Educational"
    

3. The payment method is bank transfer only.
   For software, payment in advance applies.
    

4. Invoices for services are payable within 14 days of delivery to our account shown on our invoice. A different payment period must be confirmed in writing by design engineering Erdei GmbH.

§ 6 Retention of title

1. The delivered goods remain the property of design engineering Erdei GmbH until full payment has been made.

§ 7 Compensation

1. Compensation for breach of an obligation from the contractual relationship is to be paid under the statutory requirements, but only in the case of intent or gross negligence, unless it is a matter of essential contractual obligations.
    

§ 8 data protection

1. When you disclose the data, design engineering Erdei GmbH is entitled to store and process the data required for business transactions in compliance with the Federal Data Protection Act and to pass them on to third parties insofar as this is necessary for business transactions.

§ 9 Miscellaneous

1. This contract and the entire legal relationship between the parties are subject to the law of the Federal Republic of Germany to the exclusion of the UN Sales Convention (CISG).
    

2. Complaints are to be made to the address specified in § 1.
